Short Summary of the 2025 Amended & Restated CC&Rs for Bear Lake West HOA
The 2025 Amended and Restated Declaration of Covenants, Conditions, and Restrictions (CC&Rs) replaces all previous versions and establishes one unified governing document for all properties within Bear Lake West HOA. According to the document, the purpose of this update is to eliminate “unnecessary confusion, conflict, and cost” caused by multiple older declarations.
Purpose of the HOA (the Association exists to)
• Maintain common areas and infrastructure
• Operate and oversee recreational amenities
• Protect property values
• Promote community welfare
• Enforce community standards fairly and consistently
The CCRs are binding on all property owners and run with the land.
Membership & Voting
• Membership is automatic with property ownership.
• Each Lot receives one vote and one Amenities Membership (assigned to one specified adult owner).
• Voting requires a 10% quorum.
• No fractional or cumulative voting is allowed.
• Only one owner per Lot may serve on the Board at a time.
Board Authority (the seven-member Board may)
• Adopt budgets without member ratification
• Establish and enforce rules
• Impose fines (with required notice and hearing)
• Collect assessments and place liens for nonpayment
• Maintain common areas and infrastructure
• Borrow funds when necessary
• Adopt and manage a Water Service Policy
Construction & Architectural Standards
All construction and exterior modifications require prior approval through a Building Application.
Key requirements include:
• Minimum dwelling size: 1,000 square feet on one level
• Permanent construction on approved foundations only
• No mobile homes, trailers, or relocated used structures
• No Lot subdivision (minimum lot size 15,000 sq ft)
• Construction must begin within 2 years of approval and be completed within 24 months
• Setback requirements generally 30 ft front/rear and 10 ft side for dwellings
Solar systems are permitted subject to reasonable aesthetic restrictions under Idaho law.

• Each Lot receives one non-transferable Amenities Membership.
• Amenity privileges may be suspended for unpaid assessments or violations.
Assessments & Fees
Regular Assessments:

• 18% annual interest (compounded monthly) on unpaid balances
Special Assessments:
• May be imposed for capital improvements or unexpected expenses
• Over $250 per Lot per year requires 2/3 membership approval
Transfer Fee:
• $100 per lot upon ownership transfer
Enforcement & Dispute Resolution
• Written notice and hearing required before fines are imposed
